Can you claim an Overseas Citizen of India card through a parent?
Overseas Citizen of India (OCI) card
India does not allow dual citizenship, but with an Indian parent, grandparent or great-grandparent you can register as an Overseas Citizen of India: a lifelong right to enter, live, work and study in India. It is not a passport or a vote.
What would settle itNothing on the ancestry side; note that the spouse of an Indian citizen or OCI cardholder also qualifies after two years of marriage.

No date named in India’s rule decides who qualifies. The answers above turn on the family’s facts, not on when anyone was born or left.
Claiming through your mother or grandmother
India’s rule gives the same answer whether the line runs through a mother or a father.
Dual citizenship with your home country
You keep your citizenship.
On every open route, the rule lets a citizen of the United States, Canada, the United Kingdom, Australia, New Zealand, Brazil, Argentina or South Africa keep that citizenship.

The documents, as the rule lists them
Overseas Citizen of India (OCI) card
Through a parent or grandparent or great-grandparent
Your ancestor’s Indian passport, birth certificate or domicile certificate
Birth records linking each generation to you
Your current passport
Most countries also want proof that your ancestor didn’t become a citizen somewhere else before their child was born: the naturalization record with its date, or a letter saying there isn’t one.
What it takes: time, cost, the hard part, who decides
Overseas Citizen of India (OCI) card
Time
8–16 weeks once the ancestry documents are assembled; the application itself is online and fast, the document-gathering is the long part.
Cost
About $275–350: the OCI application fee plus certified copies and translations of ancestry records.
The hard part
Documenting the ancestor’s Indian citizenship (or eligibility in 1950) with a period record — a passport, birth certificate or domicile certificate — when the family has scattered or lost the originals over three generations.
Who decides
The Ministry of Home Affairs, through the OCI portal or the nearest Indian consulate.
The first record
Your ancestor’s Indian passport, birth certificate or domicile certificate, from The state government or municipal record office where they were born or lived, or family papers. Check family papers first; if none survive, write to the municipal corporation or district record office for the birth or domicile record, and to the passport office for any old passport file. ociservices.gov.in ↗

Where
Online at ociservices.gov.in, then the printed file to VFS Global, by post or at a centre by appointment, for the mission that covers your state. Since 15 July 2025 that is the Embassy in Washington (DC, KY, MD, NC, VA, WV, Bermuda) or the Consulate General in Atlanta (AL, FL, GA, MS, PR, SC, TN, USVI), Boston (MA, ME, NH, RI, VT), Chicago (IA, IL, IN, MI, MN, MO, WI), Houston (AR, KS, LA, OK, TX), Los Angeles (10 southern California counties, AZ, NV, NM), New York (CT, DE, NJ, NY, OH, PA), San Francisco (northern California, CO, Guam, HI, UT, WY) or Seattle (AK, ID, MT, ND, NE, OR, SD, WA). The missions do not take OCI applications directly. office list ↗

Current foreign passport, valid at least six months
Proof of Indian origin: the parent’s, grandparent’s or great-grandparent’s Indian passport, Indian birth certificate or other proof of Indian citizenship after 26 January 1950
Birth certificates linking each generation to the applicant
Photographs and signature in the prescribed format (also uploaded online)
Proof of address matching the address on the application: a state driver’s license, a recent water, gas or electricity bill, or a lease signed by landlord and tenant
If the applicant (or the generation link being used) was themselves naturalized as a foreign citizen on or after 2010: a Renunciation/Surrender Certificate of Indian citizenship
Not citizenship: no vote, no public office, no agricultural land. It is a lifelong multiple-entry visa with the right to live and work in India.
Ineligible: anyone who, or whose parent, grandparent or great-grandparent, is or was a citizen of Pakistan or Bangladesh (or certain other countries the MHA specifies).
From 8 July 2026 only digital OCI cards (e-OCI) are issued to new applicants; reissuance of physical cards has been discontinued.
The applicant’s foreign passport number is tied to the OCI; follow the portal’s e-OCI rules when the passport is renewed.
A new OCI takes 4–5 weeks from the day the consulate registers the file (Atlanta’s figure), plus VFS handling and post. It cannot be expedited; for urgent travel, apply for an Indian visa while the OCI is in process.
If claiming through a grandparent, it’s the grandparent’s — not the intervening parent’s — Indian-citizenship evidence that’s asked for, and the parent’s own foreign naturalization does not itself disqualify the claim; only the applicant’s own (or their direct link’s) post-2010 naturalization triggers the Renunciation/Surrender Certificate above.

Each mission charges the OCI fee in local currency and lists it on its OCI page. Filers inside India apply to the FRRO.
Fees are each office’s published fee, converted to U.S. dollars.

For OCI, the strongest proof of an ancestor’s Indian citizenship is an Indian passport (old passport copies), then an Indian birth certificate, domicile certificate or other official record; the OCI portal accepts parents’ or grandparents’ Indian passports as proof of Indian origin.
A relative or representative in India usually has to visit the municipal office; many local bodies do not answer foreign mail. Each state sets the fee in its own rules; the 2024 model rules set Rs 20 for a search and Rs 20 for a certificate, and Rs 50 for a certificate that no record exists.
Documents in a state language need an English translation.
Passport Seva / the Ministry of External Affairs passport records, for an ancestor’s old Indian passport
If the family has lost the ancestor’s Indian passport, the passport number and issuing office are needed to ask for a record; family papers are usually faster.
The passport office does not hand an old passport file to a descendant on request. A request goes through the RTI portal, which is open only to Indian citizens, so an Indian-citizen relative files it as legal heir; the office can withhold a passport record as personal information. The family’s own papers are the faster route.
English documents need no translation. Indian records in a regional language, and foreign records in other languages, need an English translation by an authorized translator. A foreign birth or marriage certificate must also be apostilled.
India issues no passport to an OCI cardholder: the OCI (now a digital e-OCI) is used together with the holder’s foreign passport. These figures are the OCI card’s own fee (USD 275 + USD 3 ICWF + USD 19 VFS) and processing time.
If your family’s records name one of these, India’s law may be the one that applies. The town decides.

OCI cards are now liable to cancellation for serious offences
Ministry of Home Affairs notification S.O. 3662(E) of 11 August 2025, under Citizenship Act 1955 §7D(da), makes an OCI registration liable to cancellation when the holder is sentenced to at least two years’ imprisonment or is charge-sheeted for an offence punishable with seven years or more. It does not change who is eligible to register; it adds a ground to take the card away.
