Carta de Ciudadanía (naturalisation under Ley 346, litigation over 2025 decree). Naturalisation for any adult after 2 years of continuous legal residence, filed with a federal judge under the century-old Ley 346; a 2025 decree tried to move this to the immigration service and demand zero exits, but Argentina’s top electoral court nullified that transfer in June 2026.

Carta de Ciudadanía (naturalisation under Ley 346, litigation over 2025 decree)

Full citizenship and passport.

Who qualifies

  • At least 18, with 2 years of continuous legal residence immediately before applying, filed with and decided by a federal judge under Ley 346, not by the immigration service.
Ley 346, texto actualizado, Art. 2
  • DNU 366/2025 had tried to redefine "continuous" as zero exits from Argentina and move processing to the immigration service (RaDEX); the Cámara Nacional Electoral declared that transfer null on June 30, 2026, restoring federal-judge processing under Ley 346, and a federal court in Esquel separately struck down the specific articles imposing the zero-exit rule.

Whether you keep your U.S. citizenship depends on the option you choose later.

1

Does it fit your family?

One question, from the program’s own rules.

How old are you?

Not legal advice.

2

What it takes.

Age
18 or older.
Time
2 years of continuous residence (courts, not the DNU’s zero-exit standard, now govern what counts as continuous), plus months of judicial processing before a federal judge.
Cost
No investment or program payment; budget for certified records, translations and ordinary court-document costs.
The hard part
The applicant must prove two years of continuous residence to the federal judge with jurisdiction, using the residence and travel record after the 2026 rulings voided the decree’s zero-exit definition.
3

Citizens by 2030.

If your first permit is issued in 2027 and you keep living there, this is the road.

  1. 2027
    Residence begins

No permit term of its own; the clock runs on legal residence.

  2. 2029
    Apply for citizenship
  3. 2030
    Citizenship
Time away
Two years of continuous residence immediately before applying. File before the federal judge with jurisdiction, who assesses continuity from the complete residence and travel record.
Two passports
Yes. You keep your U.S. citizenship.
  • Not a permit: after 2 years of continuous residence on any lawful status, petition a federal judge under Ley 346. The judge assesses continuity from the complete residence and travel record.
  • How long the decision takes isn’t published; we allow a year.
