Can you claim Belgian citizenship through a parent?
Attribution by descent (Art. 8)
A child born abroad to a Belgian parent who was born in Belgium is Belgian automatically. If your parent was also born abroad, you are Belgian only if they declared for you before you turned 5.
What would settle itWhere your Belgian parent was born, and if abroad, whether they filed the declaration before you were 5.
- A child born abroad is Belgian if a Belgian parent was born in Belgium, or, where the parent was also born abroad, if the parent makes a declaration claiming Belgian nationality for the child before the child’s fifth birthday. Code of Belgian Nationality, Art. 8 (attribution by descent; declaration before age 5 for children born abroad to a parent also born abroad), Art. 8 §1
- The Constitutional Court held the five-year rule unconstitutional in so far as it leaves no option for a child whose Belgian parent, born abroad, died within the five years without declaring (the parent in that case was born in Turkey in 1982, naturalised Belgian in 2006, and had the child in Turkey in 2014). Constitutional Court, judgment 51/2026 of 23 April 2026 (ECLI:BE:GHCC:2026:ARR.051)
- A Belgian born abroad who lives abroad from 18 to 28 loses Belgian nationality at 28 unless they declare to keep it; a Belgian passport or identity card issued in those years counts as that declaration. Belgian consular service: loss at 28 (Code of Belgian Nationality, Art. 22 §1 5°)
