Can you claim Brazilian citizenship through a parent?
Citizen by descent
A child of a Brazilian parent is Brazilian and is registered at the consulate.
- Children of a Brazilian parent born abroad are Brazilian by birth if registered at a Brazilian consulate, or if they come to live in Brazil and opt after majority. Constitution of Brazil, Art. 12(I)(c): children of a Brazilian parent born abroad and registered at a consulate, or who reside in Brazil and opt, Art. 12(I)(c)
What changes the answer
- LIKELYIf someone in your family became a citizen of another country before the next person in your family was born
Since October 2023 acquiring another nationality no longer ends Brazilian nationality, which is lost only on the person’s express request; before then the loss had to be formally declared, so a parent’s naturalization abroad rarely stopped citizenship passing down on its own. Constitutional Amendment 131 of 3 October 2023, amending Art. 12 §4, Art. 12 §4(II)
- LIKELYIf you don’t know whether anyone in your family naturalized elsewhere before the next birth
