Mexican citizenship by descent

Who qualifies, generation by generation

The dates that matter

No date named in Mexico’s rule decides who qualifies. The answers above turn on the family’s facts, not on when anyone was born or left.

Claiming through your mother or grandmother

Mexico’s rule gives the same answer whether the line runs through a mother or a father.

Dual citizenship with your home country

You keep your citizenship.

On every open route, the rule lets a citizen of the United States, Canada, the United Kingdom, Australia, New Zealand, Brazil, Argentina or South Africa keep that citizenship.

• Holding this citizenship alongside another is addressed by the law cited; check the current position before relying on it. Political Constitution of the United Mexican States, Art. 30(A)(II) as amended 17 May 2021: Mexicans by birth include those born abroad to a Mexican parent ↗

Every way to apply, and the law behind it

The documents, as the rule lists them

Most countries also want proof that your ancestor didn’t become a citizen somewhere else before their child was born: the naturalization record with its date, or a letter saying there isn’t one.

What it takes: time, cost, the hard part, who decides

Fees are each office’s published fee, converted to U.S. dollars.

Where each record lives, and how to ask for it

• birth1860–2026

The Registro Civil of the Mexican state where the birth was registered (each state’s Dirección del Registro Civil and its municipal oficialías), served nationally through RENAPO’s online platform.

Online by CURP on the national platform (the entity of registration is chosen first). If the acta is not digitised or has errors, write to the state Registro Civil or the oficialía of the town (template), or have a relative in Mexico request it in person.

  • Each state sets the fee, from MXN 59 (Quintana Roo) to MXN 254 (Baja California), about MXN 139 on average in 2026; the portal shows the exact amount before payment.
  • Since 2026 the online acta requires a Llave MX account (CURP, email, phone) and a captcha, so it is not agent-automatable without the member’s own login; the printed digital acta with electronic signature has full legal validity.
  • Alternative: any Mexican consulate prints certified copies of Mexican civil-registry actas for $20 each (2026 consular fee table), by appointment.
  • Actas registered late (not in the year of birth) are ‘extemporáneas’ and some consulates ask for supporting documents.
  • The online acta comes from the national database at miregistrocivil.gob.mx. An older acta not yet captured there is still in the oficialía’s paper book: ask that state Registro Civil or oficialía to capture it into the national database (then it downloads like any other) or to issue a certified paper copy.
  • No single national postal address or email exists for an un-digitised acta: each state’s Registro Civil or municipal oficialía handles its own paper requests; write to it directly with the letter template.

• birth1600–1859

The Catholic parish (fe de bautismo), with older books often at the diocesan archive. Civil registration began with the Reform Laws of 1859–1860.

The parish of the town of birth; FamilySearch’s filmed Mexican parish registers help find the entry first.

  • Practically never needed: every generation after 1860 has a civil acta, and the consulate needs only the parent’s Mexican acta.
  • Each parish sets its own charge, often framed as a donation; MXN 300–500 is common. The letter asks the amount and how to pay it.

• marriage1860–2026

The Registro Civil of the Mexican state where the marriage was registered; a Mexican’s marriage abroad may be registered at a Mexican consulate.

Not required for registering a birth at a consulate (the application only records whether the parents were married); needed only to fix a name discrepancy.

• citizenship

The Secretaría de Relaciones Exteriores (SRE), through any consulate: the Declaratoria de nacionalidad mexicana por nacimiento, for a Mexican by birth who lost Mexican nationality by naturalizing elsewhere before 20 March 1998.

Needed only if the Mexican parent or grandparent naturalized in another country before 20 March 1998. Since the decree of 22 July 2004 it can be requested at any time.

  • Form DNN-2, the certified Mexican acta, photo ID, the foreign naturalization document (apostilled and translated), two colour photos; $24 at a consulate (2026 table) or MXN 265 at the SRE in Mexico.
  • The SRE says the procedure must be done personally, no proxies: a deceased ancestor cannot obtain it.
  • A parent who naturalized abroad before 20 March 1998 gets the Declaratoria first. To register a child born before that date, bring the parent’s Mexican acta, the Declaratoria and the U.S. naturalization certificate: the SRE’s list of people consulates cannot register does not include this case.
